GENERAL INFORMATION

  1. This Privacy Policy is a document that provides rules for the processing of personal data and the use of cookies in connection with the use of the website www.ludism.world (hereinafter: the "Site").

§ 1 SITE ADMINISTRATOR

The administrator of the website is NOKE spółka z ograniczoną odpowiedzialnością seated in Warsaw, Aleja 3 Maja 7A, lok. 30, 00 - 401 Warsaw, registered in the register of entrepreneurs of the National Court Register XII Economic Department of the National Court Register under KRS number: 0000509940, NIP: 7010426951, REGON 7010426951 (hereinafter also: "Administrator").

§ 3 KEY INFORMATION

An abbreviated version of the most important principles related to privacy:

  • By creating a user account through the Site, placing an order, subscribing to a newsletter, filing a complaint, withdrawing from a contract, or simply contacting the Administrator, the Customer provides the Administrator with his or her data, and the Administrator guarantees to the Customer that his or her data will remain confidential, secure, and will not be made available to any third party without the Customer's express consent, unless necessary under applicable law or justified by the Administrator's interest,

  • The Administrator entrusts the processing of personal data only to proven and trusted providers of personal data processing services.

  • The administrator uses Google Analytics analytical tools that collect information about customers' visits to the site, such as the subpages they viewed, the time they spent on the site, and transitions between subpages. Google LLC's Google Analytics cookies are used for this purpose. As part of the mechanism for managing cookie settings, the Customer has the option to decide whether or not the Administrator will also be able to use marketing functions as part of the Google Analytics service.

  • The administrator uses proprietary cookies for the proper operation of the site.

§ 4 PERSONAL DATA

  1. Personal data controller

    • The administrator of the Customer's data within the meaning of the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016. on the protection of natural persons about the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (General Data Protection Regulation) - hereinafter: "RODO" is the company NOKE Spółka z ograniczoną odpowiedzialnością, registered in the Register of Entrepreneurs of the National Court Register XII Economic Department of the National Court Register under the KRS number: 0000509940, NIP 7010426951, REGON number 7010426951, Aleja 3 Maja 7A, lok. 30, 00 - 401 Warsaw.

  2. The purposes, legal basis and duration of personal data processing are indicated separately for each purpose of data processing (see description of individual purposes of personal data processing below).

  3. The RODO grants you the following potential rights related to the processing of your data:

    • The right to access personal data,

    • The right to rectify personal data,

    • The right to delete personal data,

    • The right to restrict the processing of personal data,

    • The right to object to the processing of personal data,

    • The right to data portability,

    • The right to file a complaint with the supervisory authority,

    • The right to revoke consent to the processing of personal data, if the Customer has given such consent.

  4. The rules related to the exercise of the indicated rights are described in detail in Articles 16 - 21 of the RODO. The Administrator encourages the Customers to familiarize themselves with these provisions, and we explain that the rights indicated above are not absolute and will not be available to the Customer regarding all processing operations of his/her data. However, the Administrator has made an effort to indicate the entitlements to which the Customer is entitled under these operations as part of the description of individual personal data processing operations.

  5. If the Customer believes that the Administrator has violated data protection laws in the processing of his/her personal data, he/she has the opportunity to file a complaint with the supervisory authority (President of the Office for Personal Data Protection).

  6. The customer may also always request that the Administrator provide him with information about what data it holds on him and for what purposes it processes them. To do so, send a message to office@nokearchitects.com. The email address provided above can also be used for any questions related to the processing of personal data.

  7. The Administrator does not transfer the Customer's data to third countries or international organizations.

§ 4 SECURITY (Note: Duplicate §4, keeping content separate as per original structure)

  1. The Administrator guarantees the confidentiality of any personal data provided to him and ensures that all security and data protection measures required by data protection laws are taken. Personal data shall be collected with due diligence and shall be properly protected from access by unauthorized persons.

  2. We entrust the processing of personal data to the following entities:

    • Furgonetka Spółka z ograniczoną odpowiedzialnością Sp. k., al. Księcia Józefa Poniatowskiego 1, 03-901 Warsaw, NIP: 1132567365, REGON: 140220084, KRS: 0000694708 - to perform transport and delivery services in fulfillment of an order.

    • Fakturownia z ograniczoną odpowiedzialnością with its registered office in Warsaw at Juliana Smulikowskiego 6/8, 00-389 Warsaw, KRS: 0000572426, REGON: 362333847, NIP: 5213704420 - to perform services related to the issuance, storage and management of accounting documents and invoices.

    • Shopify International Ltd. based in Dublin, Ireland, at: Attn: Data Protection Officer, c/o Intertrust Ireland, 2nd Floor, 1-2 Victoria Buildings, Haddington Road, Dublin 4, D04 XN32, Ireland - to perform services related to the operation of the e-commerce platform, payment processing, order management and the provision of technical support and customer service.

    • All entities to which the Administrator entrusts the processing of personal data shall guarantee the application of appropriate measures for the protection and security of personal data required by law.

§ 5 PURPOSES AND PROCESSING ACTIVITIES

  1. User account

    • When creating a user account, the customer must provide their e-mail address, define a password for the account, company name, tax ID, address, and telephone number. Providing the data is voluntary, but necessary to create an account.

    • The data entered by the customer within the user account is processed solely for the purpose of maintaining the account and ensuring its use.

    • The legal basis for the processing of the Customer's personal data within the user account is the execution of the account agreement that the Customer enters into on the basis of the account regulations - Article 6(1)(b) of the RODO.

    • The data collected in your account is processed within the Shopify system and stored on a server provided by home.pl.

    • Customer data will be processed within the account as long as they have user accounts. After deletion of the account, the Customer's data will be deleted from the database, with the exception of data on orders placed.

    • At any time, the Customer may access his/her personal data processed under the account by writing an email to office@nokearchitects.com. The customer can modify their data at any time, as well as delete it, except for data on orders placed. He can also decide to delete his account at any time.

    • About the data collected in the user's account, the customer also has the right to data portability, as referred to in Article 20 of the RODO.

  2. Orders

    • When placing an order, the customer must provide the data necessary to complete the order, i.e., name, company name, billing address, nip, delivery address, e-mail address, and telephone number. Providing data is voluntary, but necessary to place an order.

    • Data provided to the Administrator in connection with an order, are processed to process the order (Article 6(1)(b) RODO), issuing an invoice (Article 6(1)(c) RODO), including the invoice in the company's accounting records (Article 6(1)(c) RODO), and for archival and statistical purposes (Article 6(1)(f) RODO).

    • The data contained in an order placed through the store is processed within the Shopify system and stored on a server provided by home.pl.

    • If the customer has a user account, the order will be visible within the order history of the account.

    • Each order is documented with a receipt or electronic invoice. Invoices are issued with the use of the Invoice House system.

    • Orders are also recorded in the Administrator's internal database for archival and statistical purposes.

    • Order data will be processed for the time necessary to process the order, and then until the expiration of the statute of limitations for claims under the contract. In addition, after the expiration of this period, the data may still be processed by the Administrator for statistical purposes. The Administrator is obliged to keep invoices with personal data for a period of 5 years from the end of the fiscal year in which the tax obligation arose.

    • In the case of order data, it is not possible to correct such data after the order has been processed. The customer also cannot object to the processing of data and demand deletion of data until the expiration of the statute of limitations for contractual claims. Similarly, he cannot object to the processing of data and demand the deletion of data contained in invoices. However, after the expiration of the statute of limitations for claims under the concluded contract, he may object to the Administrator's processing of his data for statistical purposes, as well as demand the deletion of his data from the Administrator's database.

    • In relation to order data, the Customer also has the right to data portability as provided in Article 20 of the RODO.

  3. Newsletter

    • If a customer wishes to subscribe to the newsletter, he or she must provide the Administrator with his or her e-mail address via the newsletter subscription form.

    • The data provided to the Administrator when signing up for the newsletter is used to send the newsletter to the Customer, and the legal basis for its processing is the consent (Article 6(1)(a) of the RODO) expressed when signing up for the newsletter. Personal data necessary for sending the newsletter are processed exclusively by the Administrator.

    • The data will be processed for the duration of the newsletter's operation, unless the customer opts out earlier, which will result in the deletion of his/her data from the database.

    • At any time, the customer may rectify his/her data stored in the newsletter database, as well as request its deletion by opting out of receiving the newsletter. He or she also has the right to data portability, as stated in Article 20 of the RODO.

§ 6 COMPLAINTS AND WITHDRAWALS

  1. If the customer makes a complaint or withdraws from the contract, he/she provide the Administrator with personal data contained in the content of the complaint or withdrawal statement, which includes name, address, telephone number, e-mail address, and bank account number.

  2. Data provided to the Administrator in connection with the filing of a complaint or withdrawal from the contract is used for the purpose of the complaint procedure or withdrawal procedure (Article 6(1)(c) RODO).

  3. The data will be processed for the time necessary to carry out the complaint procedure or the withdrawal procedure. Complaints and withdrawal statements may also be archived for statistical purposes.

  4. In the case of data contained in complaints and declarations of withdrawal from the contract, the customer does not have the opportunity to correct such data. Neither can he object to the processing of the data and demand the deletion of the data until the expiration of the limitation period for claims under the concluded contract. However, after the expiration of the limitation period for claims under the concluded contract, the Customer may object to the Administrator's processing of his or her data for statistical purposes, as well as demand that the data be removed from the Administrator's database.

§ 7 E-MAIL CONTACT

  1. When contacting the Administrator by e-mail, including sending an inquiry through the contact form, the Customer naturally provides the Administrator with their e-mail address as the sender of the message. In addition, he or she may also include other personal information in the body of the message.

  2. In this case, the Customer's data is processed to contact the Customer, and the basis for processing is Article 6(1)(a) RODO, i.e., the Customer's consent resulting from initiating contact with the Administrator. The legal basis for post-contact processing is the legitimate purpose of archiving correspondence for internal purposes (Article 6(1)(c) RODO).

  3. The content of the correspondence may be subject to archiving and the Administrator is not able to determine when it will be deleted. The Client has the right to request the history of correspondence he or she has had with the Administrator (if it was subject to archiving), as well as to request its deletion, unless its archiving is justified due to the Administrator's legitimate interests, such as defense against potential claims by the Client.

§ 8 COOKIES AND OTHER TRACKING TECHNOLOGIES

  1. The Administrator's website, like almost all other websites, uses cookies to provide customers with the best user experience.

  2. Cookies are small text information stored on the Customer's terminal device (e.g. computer, tablet, smartphone), which can be read by a data communications system.

  3. Cookies can be divided into their own cookies and third-party cookies.

  4. Cookie consent

    • When visiting the site for the first time, a notice about the use of cookies is displayed, along with a question about consent to the use of cookies. The customer always has the option to change the cookie settings from their browser or to delete cookies altogether, however, please note that disabling cookies may cause difficulties in using the site, as well as many other websites that use cookies.

  5. Custom cookies

    • We use proprietary cookies to ensure the proper operation of the site.

  6. Third-party cookies

    • The Administrator's website uses functions provided by third parties, which involve the use of cookies from third parties. The use of such cookies is described below.

§ 9 ANALYSIS AND STATISTICS

  1. The administrator uses cookies to track site statistics, such as the number of visitors, the type of operating system and browser used to browse the site, time spent on the site, sub-pages visited, etc. The Administrator uses Google Analytics in this regard, which involves the use of cookies from Google LLC. As part of the mechanism for managing cookie settings, the customer has the option to decide whether or not the Administrator will also be able to use marketing functions as part of the Google Analytics service.

  2. The administrator uses Google AdWords marketing tools. This involves the use of cookies from Google LLC regarding the Google AdWords service. As part of the mechanism for managing cookie settings, the customer has the option to decide whether or not the Administrator will be able to use Google AdWords in this case.

§ 10 SERVER LOGS

  1. Using the site involves sending queries to the server where the site is stored. Each query directed to the server is recorded in the server logs.

  2. The logs include, among other things, the Client's IP address, the date and time of the server, information about the web browser and the operating system it uses. Logs are saved and stored on the server.

  3. Data recorded in server logs is not associated with specific individuals using the site and is not used by the Administrator to identify the Customer.

  4. Server logs are only auxiliary material for the administration of the site, and their contents are not disclosed to anyone except those authorized to administer the server.
